These Sale Terms apply to any purchase from the Pets Around The Clock website. By clicking on the 'Pay Now' on the shopping cart order you agree to bound these terms.

1. Definition of Certain Wordsback to top
As part of our website, the following words have the meanings as set out below:

"Content" means any software, data, information, graphics, pictures and other materials published or displayed on the website, including all third party content and user generated content.

"Affiliated Website" means any website (other than the website of Pets Around The Clock) that is still operated by Pets Around The Clock.

"Delivery" means providing the products as per a product order to you or leaving the products as per a product order at the front door or similar requested instruction by you.

"Member" means the person that has completed the membership registration process and created an online account through our website.

"Product" means the goods and/or services being offered by us and promoted through the website or Affiliated Website.

"Product Information" means the description and information relating to a product as displayed on the product page.

"Product Page" means the page on the website where the specific product is displayed.

"Product Order" means your shopping cart order once completed in the check out and confirmed by us as accepted.

"Shopping Cart" is the purchase section of the website which displays the product/s that you have ordered prior to becoming a confirmed product order.

"User" means any user of the website.

"We", "Us", "Our" and "Pets Around The Clock" are the reference for Pets Around The Clock Pty. Ltd.

"Website" means this website – Pets Around The Clock

"You" and "Your" are the reference to you, the user of the website.


2. Your Orderback to top

Your order will be made up of the product or products that you select from our website.
a. You should check that your membership details and shipping address are correct.
b. You should check that the shopping cart contains all the products that you have selected.
c. You should check that the shopping cart shows the correct quantities for each product selected.
d. You acknowledge and agree that by submitting your shopping cart, you have made a legal commitment to purchase the products from our website.
e. Once your shopping cart has been completed and payment has been approved, you will receive an onscreen confirmation invoice (marked as paid) along with a copy to your email address. Both of these can be printed if needed. Please always keep a copy of the invoice as your proof of purchase.
f. Should an item be 'out of stock' with our logistics warehouse, we will contact you by email advising of the out of stocked item and will refund the amount paid for the shorted item back to you via paypal. If your purchase included a freight charge, then either the full amount charged or portion thereof will also be refunded.


3. Pricingback to top
a. All prices are displayed in Australian Dollars (AUD)
b. All prices are inclusive of Australia GST
c. Product prices may change for time to time. The price that you would pay for a product, is the price advertised when you click the 'Pay Now' on the website.


4. Paymentback to top
a. All payments are to be made in Australian Dollars (AUD)
b. You must pay for products purchased using a debit card, credit card or any other payment method. Our payment portal is SSL secured and we use the PayPal system for your added security.
c. Additional bank charges may apply for certain transactions – please consult your financial institution if unsure.
d. Title to products passes to you upon payment being cleared by PayPal.
e. Your payment transaction will show on your bank statement as 'Paypal'.


5. Transaction Delivery, Cancellation and Limitationsback to top
a. Delivery is only available in Australia (considered to be mainland Australia and Tasmania).
b. Delivery is only to a physical address. We do not deliver products to Post Office Boxes.
c. Product orders will be delivered by either Australia Post or Freight Carrier – depending on size and type of product purchased.
d. Stated delivery times are referred to as working days (meaning every day excluding Weekends and Public Holidays) and are estimates only.
e. We will attempt to notify you by email should there be an expected delay in the delivery.
f. Quoted estimated delivery times refer from Sydney to Capital City. Delivery to rural and regional areas may take longer due to transit times.
g. We will not be liable to you for any damages, costs or expenses of any kind, incurred or suffered by you due to the order not being fulfilled or the order not being delivered with an anticipated time.
h. We shall bear the risk of loss or damage to the product until delivery to you. Risk in the products shall pass to you on delivery.
i. In the event that a product order has not been delivered (i.e lost in transit), or the products were spoiled or damaged on arrival – we will offer a replacement of the product at no charge and no freight charge to send the replacement to you.
j. You must provide photographic evidence if the goods are damaged, which can be emailed to us using the 'contact us' and clicking add attachments.
k. In the event that the item in point (i) cannot be replaced, we shall over you a refund of the purchase price or credit towards your next purchase.
l. If you are unable to accept the delivery of your product order, most freight carriers will leave a calling card with a contact number. You may be charged an additional fee for a redelivery, or you will need to contact the number on the calling card and arrange to collect the goods from a stated depot.
m. If your delivery of products is not as expected or we inadvertently have shipped the incorrect goods to you, please contact us using the 'contact us' form. We will arrange to have the incorrect goods collected from your address and the correct goods will be sent at no charge.
n. Except for where a product may not be available (after you have clicked 'checkout') you may not cancel your product order once you have received the confirmation invoice on screen or by email. This is our confirmation of accepting your order.
o. We may refuse to process a product order for any reason at any time at our sole discretion. This may occur due to a product recall, fault with a product or similar reason. In this event we will contact you as soon as possible and either offer a similar replacement product or a full refund.
p. We do not accept product orders from outside of Australia.


6. Samplesback to top

We may from time to time include samples of other products with our customer deliveries. There is no obligation to purchase or return the samples.


7. Warrantiesback to top
a. We honour all stated and said product warranties as per the terms and conditions of the individual product's warranty.
b. You must keep your original purchase receipt as we may ask for a copy of the receipt to be returned along with the product to our return address (which will be provided by email). In the event of a warranty claim please use the 'contact us' form.
c. If we need to have the product returned to us, the freight cost is at your expense. If the warranty claim is approved, we will forward a replacement product to you at our expense.
d. Please make sure that the returned product is clearly labelled with your name, return address, nature of the fault and your best contact number.


8. Returns back to top
If you wish to return a product for repair due to a fault use the 'contact us' form.
You must keep your original purchase receipt as we may ask for a copy of the receipt to be returned along with the product to our return address (which will be provided by email). Please ensure that the returned item is clearly labelled with your name, address, contact number and possible fault.
Please note – we will not repair dirty pet bedding, dirty aquarium filters (clean & dry them first please), broken zippers, torn bedding or other problems that may be considered normal wear and tear.
If the item can be repaired and it is not under warranty, you may be charged for the repair. We will contact you prior to any repair being undertaken to advise you of the cost.


9. Severabilityback to top
Should any part or portion of these terms be deemed invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.


10. Lawback to top
The terms of our website are governed by and will be construed in accordance with the laws of Australia.
